Terms and conditions
General Rental Conditions of SunRentals Bonaire.
These general conditions are accepted by the tenant once a reservation is made, and the (partial) payment is completed. In these general conditions, the word "I" refers to the tenant. Where the word "villa" is used, it should be read as accommodation, house, apartment, or studio in the event of renting a different type of accommodation, house, apartment, or studio.
1. Tenant rents the rented property at their own risk; indemnification
By making the reservation for the villa, I confirm that the use of the villa and the facilities inside and outside the villa, including the garden, pool, pool deck, gazebo, garden houses, and access to the sea (if applicable to my reservation), will be entirely at my own risk. I hereby accept all risks of accidents (or death) to myself, my family, and my guests during my stay in the villa and/or while using the facilities of the villa. By fully accepting these risks of death and accident, I understand that I absolve and indemnify the owner of the villa (and in the case of a legal entity, the ultimate economic beneficiary) and/or SunRentals Bonaire and/or its employees from all losses, costs, claims, damages, and liabilities arising from death or accident during or related to my rental or use of the villa or its facilities. This indemnification also applies to my family and guests, and I will ensure that they are informed of these general conditions.
2. Tenant is liable for damage to the rented property; USD 500 deposit
By making the reservation for the villa, I also acknowledge that I will be financially responsible for any damage to the villa, its interior, and/or its facilities (inside and outside, including the garden, pool, pool deck, gazebo, garden house, and access to the sea) incurred during my stay, whether caused by me, my family, or my guests. I agree that all damage caused to the villa and/or its interior and/or facilities (inside and outside) by me, my family, or my guests will be charged to my credit card, or I will arrange for payment of the damage in another way. I also agree that SunRentals Bonaire will reserve an amount of USD 500 on my credit card upon arrival as a deposit for any damage caused by me, my family, or my guests, without prejudice to the right of the villa owner to claim the actual damage from me.
3. No liability of the villa owner or SunRentals Bonaire; indemnification
By accepting the risk of damage to the villa and its interior and exterior, as provided in article 2, I also understand that the owner of the villa (and in the case of a legal entity, the ultimate economic beneficiary) and/or SunRentals Bonaire and/or its employees are not liable for the loss and/or damage to any property owned by me, my family, or my guests, wherever it may be located or for any cause that results in the loss or damage of this property. This also includes items stored in the safe (if applicable to my booking). Loss, theft, or damage to my belongings or those of my family or guests are not covered by the owner's villa liability insurance, and I understand that I must arrange for my own (travel) insurance. Items left in the villa after my departure will be sent to my home address at my request and expense, but may also be removed and/or destroyed by SunRentals Bonaire or the villa owner.
Furthermore, I understand that the owner of the villa (and in the case of a legal entity, the ultimate economic beneficiary) and/or SunRentals Bonaire and/or its employees are not liable for damage or inconvenience caused by power outages or technical malfunctions of appliances in and around the villa (which appliances will be repaired as soon as reasonably possible in case of malfunction) or for any other case of force majeure.
4. Payment conditions
I accept that I must make a 20% down payment to confirm my reservation. I agree that this 20% down payment will not be refunded under any circumstances. Payments are made by credit card or bank transfer, and all bank/collection costs are at my own expense. In case SunRentals Bonaire does not receive the 20% down payment, the reservation automatically becomes void.
The remaining portion (80%) will be debited from the same credit card no later than 4 weeks before arrival, or it must be received by SunRentals through a bank transfer. I understand that there will be no prior reminder for this payment, and all bank/collection costs for this payment are at my own expense. I understand that I am responsible for timely payments. This 80% payment will not be refunded under any circumstances. In case of a late payment, a reminder will be sent, and SunRentals Bonaire has the right to charge an additional 15% of the amount to be received. If the full reservation amount is still not received within 7 days before arrival, SunRentals Bonaire has the authority to cancel the reservation without refunding any earlier received payments.
I accept that SunRentals Bonaire reserves an amount of USD 500 on my credit card in accordance with article 2, without prejudice to the right of the villa owner to claim the actual damage from me. If a deposit of USD 500 cannot be reserved on my credit card, I must transfer or pay the USD 500 deposit in cash, and I understand that access to the house may be denied without a deposit.
All amounts mentioned on the SunRentals Bonaire website, social media, advertisements, and in quotes and reservation confirmations are in US Dollars unless specifically discussed and agreed otherwise.
5. Cancellation by tenant
1. Tenant can cancel the reservation or assign a replacement tenant at any time, provided SunRentals explicitly agrees to the replacement tenant.
2. In the case of a replacement tenant, the replacement tenant and the original tenant are jointly responsible for timely payment of the amounts due to SunRentals Bonaire.
3. Cancellation or request for a replacement tenant must be made by email and is only valid after confirmation by email from SunRentals Bonaire.
4. In case of cancellation of a reservation, the tenant owes payment to SunRentals Bonaire:
- Twenty percent (20%) of the total reservation amount in case of cancellation up to four (4) weeks before the start of the stay;
- One hundred percent (100%) of the total reservation amount in case of cancellation within four (4) weeks before the start of the stay.
6. Cancellation by SunRentals Bonaire
1. SunRentals Bonaire can cancel or modify a reservation at any time if there is:
- Force majeure (e.g., war, strike, natural disaster, extreme weather conditions, fire, death of homeowner or landlord, unannounced sale of the rented property, occupation by new owner of the rented property, etc.);
- Serious and, after being warned by SunRentals Bonaire or the owner, persistent nuisance to the (natural) environment and neighbors by the tenant and/or other users, or when the tenant and/or other users do not use and treat the accommodation as a good tenant should.
2. In the event of any of the above events occurring and not due to the fault or negligence of the tenant or their guests, SunRentals
will, to the extent possible, try to offer alternative accommodation. If no alternative accommodation can be provided, the amount equivalent to the remaining unused nights of the accommodation will be refunded.
3. SunRentals cannot be held liable for other damages or costs resulting from the cancellation or modification of the reservation.
7. Applicable law and competent court
By making my reservation, I confirm that any dispute related to my stay (and that of my family and guests) in the villa and/or any claim as described in the preceding articles and/or any other matter related to my stay and/or reservation is subject exclusively to the law of the Caribbean Netherlands, and the court in Bonaire has exclusive jurisdiction to decide on such disputes.
8. Tenant arranges their own insurance
I understand that, in connection with articles 1-4, I need to take out my own insurance for accidents and/or damages that may occur during my stay and that of my family and guests. I also understand that, in connection with article 4, I must arrange for my own cancellation insurance because there is no refund in case of cancellation, regardless of the cause of my cancellation.
9. Reservations
SunRentals Bonaire accepts reservations only from persons aged 18 or older. Reservations from persons under 18 years of age are therefore not valid.
A reservation is valid from the moment SunRentals Bonaire has received the 20% down payment. A confirmation of receipt will be sent to the email address I provided. I understand that I am responsible for checking the reservation confirmation for accuracy and completeness, and I must inform SunRentals Bonaire of any inaccuracies and incompleteness within 7 days. If such notification is not made within the specified period, I am not entitled to rely on the incompleteness or inaccuracy of the reservation.
If I want to change the reservation, SunRentals Bonaire is free to determine whether and to what extent they will accept and implement the changes. Change fees may be charged.
Subletting is not allowed.
10. Accommodation
SunRentals Bonaire makes every effort to have the villa ready for check-in by 3:00 PM but cannot guarantee this. Check-out is at 11:00 AM, unless otherwise agreed with SunRentals Bonaire.
The villa must be left in a clean condition on the day of departure. This includes, among other things, washing the dishes, placing the trash outside in the trash bin, and sweeping the floors.
The villa may not be used by more people than indicated in the reservation confirmation. If it is found that there are more users, regardless of whether they stay overnight or not, SunRentals Bonaire or the manager or owner of the villa has the right to deny the tenant and their guests access or charge an amount per additional person per day.
Smoking, parties, loud music, and pets are not allowed in the villa, unless otherwise agreed with SunRentals Bonaire.
I will follow the instructions regarding the use of the villa and the equipment as told to me or included in the instruction book (if applicable to my reservation).
In case of unforeseen circumstances or sale concerning the rented property, SunRentals may place me in alternative accommodation of the same or higher value, without additional costs to me. If SunRentals cannot offer alternative accommodation, the already paid amount will be refunded.
SunRentals Bonaire will try to schedule (necessary) maintenance outside the rented periods as much as possible; however, there will be periodic work that may also take place during a rented period. When this is the case, SunRentals will inform me, and SunRentals or the designated person/company is allowed to enter the villa to perform the work.
Lost or stolen keys or remote controls (gate/alarm) will be charged.
